- Welcome to PegasusSwap. We appreciate your interest in our platform. This document outlines the terms and conditions that govern your use of our services. Our goal is to ensure clarity and transparency regarding your legal rights, responsibilities, and the nature of your relationship with us.
- By accessing, browsing, or otherwise using PegasusSwap, you confirm that you have read, understood, and agreed to be legally bound by these Terms of Use, along with the applicable Fees and Commission Schedule available at pegasusswap.com.
- The terms “PegasusSwap,” “Services,” “we,” “us,” and “our” refer to the platform and its operators. The terms “User,” “Customer,” and “you” refer to any individual or entity accessing or using the platform and its services.
- For the avoidance of doubt, this agreement is strictly between you and the operator(s) of PegasusSwap.
Important Notice
- Please read these Terms carefully. They define your legal rights and obligations, explain the scope of services provided, and outline the limitations of our liability.
- By accepting these Terms, you voluntarily agree that any and all disputes, claims, or controversies arising out of or relating to your use of the Services will be resolved exclusively through final and binding arbitration. You expressly waive any right to bring such disputes before a court or to a jury trial.
- If you do not agree with any provision of these Terms, or if you are unwilling to waive your right to judicial proceedings, you must immediately discontinue use of the platform and its services.
- Additional terms and conditions may apply to specific features, promotions, or services. You may be required to accept such terms separately prior to accessing or using those features.
Definitions
- For the purposes of these Terms of Use, the following definitions shall apply:
- • “Platform” refers to PegasusSwap, including all interfaces, technologies, and services offered through the domain pegasusswap.com and any associated systems;
- • “User,” “Customer,” or “you” means any individual or legal entity accessing, browsing, or otherwise using the Platform and its services;
- • “We,” “us,” “our,” or “Operator” refers to the entity or individuals operating PegasusSwap;
- • “Services” means all features, tools, and functionalities provided by the Platform for the non-custodial exchange of digital assets;
- • “Digital Asset” means a cryptographically secured digital representation of value or contractual rights that uses blockchain or similar technology, including but not limited to cryptocurrencies, tokens, and stablecoins;
- • “Exchange,” ”Swap” means the transaction in which one Digital Asset is swapped for another using the Platform;
- • “Fixed Rate” refers to an Exchange where the rate is locked at the moment the Order is created and remains unaffected by market fluctuations;
- • “Floating Rate” refers to an Exchange where the rate is determined dynamically based on current market conditions at the time the transaction is executed;
- • “Network Fee” refers to the fee charged by the blockchain network for processing a transaction, which is separate from any service fees and is outside the Platform’s control;
- • “Service Fee” means the fee retained by the Platform for facilitating the exchange, as outlined in the Fees and Commission Schedule;
- • “AML/KYC” stands for anti-money laundering and know-your-customer procedures that may be applied in certain cases to comply with applicable legal or regulatory requirements;
- • “Affiliate” means a third party who promotes or refers users to the Platform in accordance with a separate agreement;
- • “Phishing” refers to fraudulent attempts to obtain sensitive information by impersonating the Platform or its representatives;
- • “Fake Token” means any token with misleading branding or lacking a valid smart contract address, which may imitate legitimate projects but hold no real value.
Eligibility
- By using the Platform, you confirm and warrant that:
- • You are at least 18 years old and have the full legal capacity to enter into binding agreements;
- • You are using only Digital Assets that lawfully belong to you and were obtained through legitimate means;
- • You are not acting on behalf of any third party and are using the Services solely for your own, non-commercial purposes;
- • You are not attempting to access the Platform from any region or location where use of such services may be restricted;
- • You are not using any technologies, including VPNs or proxies, to conceal your actual location or identity;
- • You are not listed on any sanctions list or involved in any activity that may be considered illegal, fraudulent, or abusive;
- • You fully understand the risks associated with exchanging Digital Assets, including potential financial loss and technical failure;
- • You will not use the Services to conduct or facilitate any form of unlawful activity;
- • You acknowledge and accept that the Platform reserves the right to restrict, block, or terminate access to any User who violates these Terms or poses a security or compliance risk.
Using the Platform
- To use the exchange services provided by the Platform, you must follow the process outlined below. By initiating any transaction, you confirm that you understand and accept the following conditions:
- Order Creation
- You must select the Digital Asset you wish to send and the Digital Asset you wish to receive. The Platform will display an estimated exchange rate, which may be either fixed or floating depending on your selection.
- Wallet Addresses
- You are required to provide:
- • A recipient wallet address to which the exchanged Digital Asset will be delivered;
- • An optional refund wallet address in case the transaction cannot be processed;
- • You are solely responsible for ensuring that all wallet addresses are correct, valid, and under your control. The Platform is not liable for any funds sent to incorrect or incompatible addresses.
- Payment Instructions
- After order creation, you will receive a deposit address. You must send the exact amount of Digital Asset specified in the order to this address, using the correct blockchain network and including any required identifiers (such as tags, memos, or payment IDs, if applicable).
- Timeliness of Payment
- Exchange rates may change rapidly. If your deposit is not received within the indicated time window (e.g. 30 minutes), the order may be canceled or executed at a different rate. In such cases, the Platform may offer to return the funds or complete the transaction at a revised rate, at its discretion.
- Confirmations and Processing Time
- The transaction will begin processing once the deposit receives the required number of network confirmations. Processing time may vary depending on network conditions, liquidity, or other external factors.
- Finality
- Once the exchange is executed and the output Digital Asset is sent to the provided wallet, the transaction is considered final and cannot be reversed.
- Non-Custodial Nature
- The Platform does not provide custodial services. All transactions are processed in real time and no user funds are stored or held by the Platform at any stage.
Fees and Exchange Rates
- Service Fees
- All exchanges conducted via the Platform are subject to a service fee. This fee is automatically included in the rate displayed at the time of order creation and will be deducted from the amount you receive. No additional fees will be charged unless explicitly stated.
- Exchange Rate Types
- The Platform offers two types of exchange rate options:
- • Fixed Rate: The rate is locked at the moment the order is created and remains unchanged for a limited time window (e.g. 30 minutes), provided the correct amount is received within that timeframe;
- • Floating Rate: The rate is determined at the time the Platform processes your transaction, based on real-time market conditions. The final amount may differ from the initial estimate.
- Rate Volatility
- Exchange rates for Digital Assets are highly volatile and may change rapidly due to market fluctuations. While the Platform strives to offer accurate and fair rates, we do not guarantee rate stability unless a Fixed Rate is selected.
- Network Fees
- Blockchain networks may impose transaction (mining) fees, which are outside the Platform’s control. These fees may affect the final amount you receive. You are responsible for covering any such fees when sending funds to the Platform.
- Minimum Limits
- Each supported Digital Asset may have a minimum order value. If you send less than the minimum, the Platform may be unable to process your order, and a refund may not be possible.
- Fee Updates
- The Platform reserves the right to change the service fees and minimum order amounts at any time.
Risk Disclosure
- By using the Platform and its Services, you acknowledge and accept the inherent risks associated with Digital Assets and blockchain-based transactions. These include, but are not limited to, the following:
- Volatility Risk
- Digital Asset prices are highly volatile and may experience significant fluctuations within short periods. This can result in receiving a different amount than initially expected, especially when using floating rates.
- Liquidity Risk
- Some Digital Assets may suffer from low liquidity, making it difficult to complete an exchange at the desired rate or within a reasonable time frame.
- Network Risk
- Blockchain networks may become congested or experience delays, outages, or attacks, which can affect transaction processing times and success rates.
- Technical Risk
- Incorrect wallet addresses, unsupported blockchains, failure to include required memos/tags, or incompatible tokens may lead to the loss of funds. The Platform is not liable for transactions initiated with incorrect or incomplete information.
- Finality and Irreversibility
- Transactions on blockchain networks are irreversible. Once an exchange is completed and funds are sent, it is not possible to cancel or recover the transaction.
- Security Risk
- Although the Platform implements security measures, the use of online services carries the risk of hacking, phishing, or exploitation of vulnerabilities. Users are responsible for verifying the authenticity of the Platform’s website and communications.
- Regulatory Risk
- The regulatory status of Digital Assets may change. Laws or restrictions in your country may affect your ability to use the Platform or access certain assets.
AML/KYC Compliance
- General Policy
- The Platform is committed to maintaining a secure and compliant environment. While registration or identity verification is not required for standard use, the Platform reserves the right to implement anti-money laundering (AML) and know-your-customer (KYC) procedures in specific situations.
- Trigger Conditions
- The Platform may initiate AML/KYC procedures only under the following circumstances:
- • If a wallet address involved in a transaction is flagged in sanctions or blacklists, including but not limited to public watchlists and compliance screening tools;
- • Upon receipt of a valid request from competent authorities or regulators;
- • If a transaction is manually flagged during internal risk checks related to anti-fraud, anti-terrorist financing, or asset traceability.
- User Obligations
- If requested, you agree to provide accurate and complete information for identity verification, including government-issued identification, source of funds, or other documentation deemed necessary.
- Failure to Comply
- If a User refuses to provide the requested information during an AML/KYC check, the Platform reserves the right to suspend or cancel the transaction.
- In most cases, the funds will be returned to the original sending address, unless there is a legal, technical, or compliance reason preventing such refund. The Platform may withhold a service fee or network costs incurred during the process.
- Data Handling
- Any personal or transactional data collected during AML/KYC checks will be handled securely and only disclosed when legally required or to comply with risk management policies.
- Right to Decline Service
- The Platform reserves the right to refuse service to any User who poses a compliance risk or appears to be engaged in prohibited or unlawful activity, without obligation to provide justification or prior notice.

Refund Policy
- General Rule
- All exchanges made through the Platform are final. Due to the irreversible nature of blockchain transactions, completed swaps cannot be canceled or refunded once processed.
- Exceptions
- Refunds may be issued only in exceptional cases, such as:
- • The User sent funds after the order expired;
- • The Platform was unable to process the transaction due to technical reasons;
- • The User sent an unsupported token or to the wrong network;
- • A refund is requested following a declined transaction (e.g. due to blacklist detection or AML flags).
- Refund Conditions
- In the event of a refund:
- • The funds will be returned to the original sending address, unless agreed otherwise;
- • Network fees, service charges, and any losses due to rate changes may be deducted;
- • The Platform does not guarantee refunds in cases where tokens were lost due to User error (e.g. wrong address, missing memo/tag, use of unsupported networks or fake tokens).
- Minimum Refundable Amount
- Refunds may not be issued for transactions below a certain minimum threshold, if the cost of processing exceeds the value of the transaction. The Platform reserves the right to define and update this limit.
- Refund Processing Time
- Refunds, when approved, are typically processed within 1 to 7 business days. Delays may occur if third-party services (e.g. liquidity providers, network congestion, or regulatory reviews) are involved.
- Fake or Unsupported Tokens
- The Platform does not accept responsibility for tokens sent that imitate legitimate projects but lack proper smart contract verification. Such tokens will not be refunded.
- Refund Requests
- All refund requests must be submitted through official support channels and must include the transaction ID and any additional information requested. The Platform reserves the right to request further verification before processing a refund
Prohibited Uses & Security
- By using the Platform, you agree not to engage in any activity that is illegal, abusive, manipulative, or harmful to the Platform or other Users. Specifically, you agree not to:
- • Use the Platform to launder money, finance terrorism, evade taxes, or conduct any activity that violates applicable financial regulations;
- • Attempt to access the Platform from restricted regions or circumvent restrictions using VPNs, proxies, or spoofed IPs;
- • Interfere with the Platform’s operations, exploit bugs or vulnerabilities, or attempt unauthorized access;
- • Use bots, scrapers, automated systems, or trading software not authorized by the Platform;
- • Send tokens that are counterfeit, imitation, unsupported, or have no valid smart contract;
- • Impersonate the Platform, its team, or act on its behalf without written authorization;
- • Submit false or misleading information in order to deceive or manipulate Platform behavior.
- Phishing & Fake Sites Warning
- Users are solely responsible for verifying that they are using the official Platform domain.
- The Platform is not liable for any losses resulting from the use of phishing sites, fake domains, or impersonated communications. Always check the URL and SSL certificate before interacting.
- Any violation of this section may result in immediate suspension, refusal of service, or blocking of associated assets or addresses, at the sole discretion of the Platform.
Privacy & Data Use
- Minimal Data Collection
- The Platform does not collect personal data unless explicitly required for operational, compliance, or support-related purposes. Users may access and use most Services without providing identity information.
- Voluntary Disclosure
- If you choose to contact the Platform (e.g. for support or refund inquiries), you may be asked to voluntarily provide certain personal information, such as email address, transaction ID, or wallet address.
- Use of Collected Data
- Any data collected may be used to:
- • Facilitate and support transactions;
- • Investigate technical or compliance issues;
- • Prevent fraud and enforce Platform rules;

- Disclosure to Third Parties
- The Platform may share user data with competent authorities, legal entities, or compliance providers if:

Final Provisions & Liability
- Our Responsibility to You

- No Absolute Guarantees
- While we make every effort to provide accurate information and timely service, the Platform is provided “as is”. This means there may occasionally be technical issues or circumstances beyond our control. We do not make promises regarding uninterrupted access or fixed outcomes in volatile market conditions.
- Unexpected Events (Force Majeure)
- In rare cases, events such as network failures, regulatory changes, or external system disruptions may affect the availability or execution of services. We will always do our best to resolve such situations promptly and transparently.
- Amendments
- These Terms may be updated or modified at any time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms. Users are encouraged to review the Terms regularly.
